Microsoft Blames Family for Xbox Fire, Infant Death

In a move that was largely expected legally, but could prove more difficult to explain to the media and consumers, Microsoft is asking a court to dismiss a lawsuit that claims an Xbox caught fire and led to the death of an infant. Microsoft says the baby's parents are to blame for abusing the Xbox.

It's not clear what exact "abuse" Microsoft is claiming, although it says the Kline family "knowingly, willingly, intentionally, and voluntarily exposed themselves to said danger and assumed the risk of incident." Microsoft had recalled over 14 million Xbox power cords in February 2005 due to fire risks, and it's not clear if the family participated in that recall. Microsoft is also demanding the Klines pay for the company's legal costs.

M$ is right, the parents are so neglectful and are fully to blame. If their power cord was recalled then it's their fault for not being completely tech aware all the damn time. I mean, they must have time in their lives to geek up because it's not like they're busy with a baby, jobs, family, and other important matters.

Haha! I should of thought of that before I went on my rant. It's possible that a room or the house may have caught fire....but then I would think that would be mentioned in the suit. Hmmm.

EDIT: Found another article, the house burned up. Still doesn't make sense how a baby dies while your console goes up in flames.

Why was the xbox on to start a fire in the first place? Someone would have to have been playing it and noticed the thing caught fire to put it out.

Maybe the Xbox catching on fire and burning the house is MS's fault, but the baby dying sounds really like the parents' fault. How did they get out without saving their baby? Did it explode and kill the baby or something? How come the Xbox was alone with the baby? I just don't get it and the stories don't provide the information.
If they didn't return their cord with the recall, I don't really think MS is to blame either.

As disgusted as I am in my initial reaction to the story, considering MS already recalled the cords they're really not liable. Can't really blame the parents much beyond that they should've kept a closer eye on recalls.

Apparently this fire took place in 2004, the recall in 2005.

As I said, this is a new born we are talking about... why the hell wasnt it being looked after or the parents nearby? C'mon be reasonable, this story has so many holes in it.

yah... I don't think anyone can really rightfully blame Microsoft. There is a lot of left out information. If I were to choose who to blame, it would be the parents too.

I don't know whose fault it is so this might be unfair, but you would think your infant child would be high up on the list of things to save during a fire.

Well it was number two, they tried saving the Xbox, but that obviously didn't work out well. It's not like you left the infant alone in the room so he could play Xbox. And it's not like you could say "We thought he would yell if something went wrong." It's a god damn infant, and it's not like your Xbox was actually a napalm bomb, the thing doesn't just randomly cause infernos...

Yeah, it does sound fishy... Though I guess if the fire spread fast enough, it is possible under certain circumstances that they were merely alerted to the fire too late.

If this occured before the recall, it's totally different. After the recall, and it would be solely their fault, as Microsoft had followed all procedure and notified everyone who registered with them. But before? I don't know, maybe they are entitled to some retribution regardless of how good they are at parenting.

The parenting capacity should be reveiwed by Social Services, but we all know how effective they are...

Keep in mind that infants are much more vulnerable to things like smoke inhalation, so by the time the parents knew about the fire the smoke may have already suffocated the baby. I didn't read the story, but there are a lot of factors in a fire that could kill a baby before the parents even knew the fire was there.

prolly the infants room shared the wall where the xbox was plugged thus the fire ignited the both rooms spreading to the infants much faster than the parents. all depends on the circumstances and layout of the house.
